DMCA Policy

ElderHearth ("we," "our," or "us") respects the intellectual-property rights of others and expects users to do the same. This DMCA Policy explains how copyright holders can request the removal of allegedly infringing material from elderhearth.com (the "Site") under the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512).

1. Filing a takedown notice
If you believe content on the Site infringes a copyright you own or are authorized to act for, send a written notice to hello@elderhearth.com that includes ALL of the following (as required by 17 U.S.C. § 512(c)(3)):
- Identification of the copyrighted work you claim has been infringed (e.g., a URL to your original publication, a registration number, or a clear description).
- Identification of the allegedly infringing material on our Site, including the URL(s) of the specific page(s) and a precise description of the content within those pages.
- Your contact information: full legal name, mailing address, telephone number, and email address.
- A good-faith statement that you believe the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- An accuracy statement made under penalty of perjury that the information in the notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.
- Your physical or electronic signature.
Incomplete notices may not be actionable. Notices that misrepresent infringement may subject the sender to liability under 17 U.S.C. § 512(f).
2. What happens after a valid notice
Upon receiving a complete and valid notice, we will, in our discretion:
- Promptly review the notice
- Remove or disable access to the identified material if the claim appears substantiated
- Notify the user who posted or is associated with the material (where reasonably identifiable), providing them with a copy of the notice and information about the counter-notification process
We do not adjudicate copyright disputes; we act in accordance with the DMCA safe-harbor procedure.
3. Counter-notification
If you believe your content was removed or disabled in error or as a result of misidentification, you may submit a counter-notification to hello@elderhearth.com containing ALL of the following (as required by 17 U.S.C. § 512(g)(3)):
- Identification of the material removed or disabled, including the URL where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your contact information: full legal name, mailing address, telephone number, and email address.
- A consent-to-jurisdiction statement: that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which ElderHearth may be found), and that you will accept service of process from the original notice sender (or their agent).
- Your physical or electronic signature.
If we receive a valid counter-notification, we will forward it to the original complaining party. If the complaining party does not file a lawsuit within 10–14 business days, we may, in our discretion, restore the material.
4. Repeat infringers
We will, in appropriate circumstances, terminate the access of users (including commenters, contributors, or other participants) who are determined to be repeat infringers.
5. Misrepresentation
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents either (a) that material is infringing or (b) that material was removed by mistake or misidentification may be liable for damages, including costs and attorneys' fees, incurred by the alleged infringer, the copyright owner, or any service provider as a result of the misrepresentation.
